9th Circuit Rules MMS Video Required “Conscious Choice” and Is NOT a “Pre-Recorded” Call Under the TCPA
The first court in the nation to look at the issue has held that MMS messages containing video are NOT prerecorded voice calls under the TCPA unless they play automatically.

Plaintiff’s Bar Requests SCOTUS Clarification on ATDS Definition
Over two years ago, the U.S. Supreme Court unanimously ruled [Facebook v Duguid] that a system is not an ATDS under the TCPA unless it uses a random or sequential number generator (ROSNG) to “store or produce” telephone numbers to be dialed. But since then, courts have struggled to apply this ruling.
Now a Plaintiff’s petition seeks clarification on ATDS claims.
