State Privacy Laws Take Centerstage at Consent Summit

Among the major focuses of the Summit’s content was the rising number of state-level privacy laws, which follow the lead of California’s 2018 CCPA law. Convoso Compliance Officer Tammy Glover Fowler says that industry insiders and compliance experts like herself are pushing for the creation of a federal privacy law that incorporates individual states’ concerns and simplifies compliance efforts of businesses. 

However, with little in the way of federal activity on that front, keeping up with requirements of state privacy laws should remain a central concern for businesses everywhere. One question that should be on the minds of leaders is whether their online marketing language is compliant and its relationship to consent can be clearly understood. Glover Fowler recommends working with counsel to ensure that marketing language is not deceptive in any way.

Clear Checks and Balance Remain Crucial to Compliance Support

 

Another key lesson of the conference’s content cleared up a common misconception about compliance implementation. 

According to Glover Fowler, many decision-makers don’t quite understand that while striving to be 100% compliant, there will always be some residual risks.  She says, “Do your best to establish compliant policies and procedures so that if your practices are questioned by regulators, you can demonstrate that you have controls in place to comply with the regulations; additionally, allow them to take a look at your checks and balances.’”
